Local Law Firm Partner Failed To File NYS Income Tax Returns For Six Consecutive Years
ALBANY, NY (07/27/2009)(readMedia)-- New York State Department of Taxation and Finance Acting Commissioner Jamie Woodward announced today that D. Scott Young, 49, a resident of Honeoye Falls and partner in the Rochester law firm of Ashcraft, Franklin & Young, LLP, pled guilty Friday to one misdemeanor count for failing to pay his personal income taxes for tax years 2002-2007.
Young entered the plea before the Hon. Stephen T. Miller, Acting Monroe County Court Judge. Prior to the plea, Young had filed the delinquent returns and paid the Tax Department $41,484 in back taxes, interest and penalties.
Young's delinquencies were discovered after the Tax Department's Special Investigations Unit in the Rochester District Office conducted a random phone book search of attorney listings, looking to identify lawyers and other professionals who neglected to file personal income tax returns.
Commissioner Woodward said, "Tax cheats can be found among all professions, from blue collar workers to high-wage earners in the medical and legal fields. Regardless of how they cheat, these scofflaws force all other New Yorkers to shoulder a greater share of the tax burden, taxes that pay for essential services such as health care, education and transportation. The Department is committed to pursuing all tax cheats so that every New Yorker pays their fair share.
"The Department offers programs such as the Voluntary Disclosure and Compliance Program to encourage delinquent taxpayers to become compliant without facing criminal prosecution or civil penalty. It is hoped that this case will encourage such taxpayers to come forward and satisfy their tax obligation.
Commissioner Woodward thanked Monroe County District Attorney Michael C. Green for prosecuting this case
