Hornell cousins charged with Criminal Possession of a Controlled Substance in the 3rd Degree

Avon: Sheriff John M. York advises of the arrest of two subjects from
Hornell,NY on felony drug charges. 20 year old Robert L. Smith and his
cousin 23 year old Joshua E. Smith were both charged with Criminal
Possession of a Controlled Substance in the 3rd Degree (a Class B Felony)
and Criminal Possession of a Controlled Substance in the 7th Degree (a
Class A Misdemeanor.) Joshua E. Smith was also charged with Criminal
Possession of Marihuana in the 5th Degree (a Class A Misdemeanor.)
Deputy Shawn Whitford stopped the vehicle the two were in after they failed
to yield the right of way exiting the Mobil Gas Station at exit 9 in the
Town of Avon. They pulled out into traffic in front of another vehicle
and were then stopped on Triphammer Road. After investigation a quantity
of marihuana, cocaine, and exctasy was located in the vehicle and seized by
the Sheriff's Office.
Deputy Whitford is a police K-9 handler and his narcotics dog, Utah, was
utilized to help find the location where the drugs were hidden in the
vehicle.
The Smith Cousins were arraigned before Judge Michael Torregiano in the
Town of Avon Court and both were remanded to the Livingston County Jail on
$5000 cash bail. Deputy Michael Williams, Deputy Caleb Cutting, and Sgt.
Michael Dougherty assisted.
